A Classic Example of Courage and Conviction

The partisan chasm between Democrats and Republicans appears wider than ever, making bipartisan compromise on Capitol Hill increasingly challenging.

However, reflecting on the recent passing of former Congressman William (Bill) Delahunt, we’re reminded of a different era when opposing sides collaborated to address critical issues in the criminal justice system.

Former Chairman Jim Sensenbrenner (R-Wis.) and Congressman Delahunt (D-Mass.) joined forces to advance the Innocence Protection Act despite stark ideological differences.

Assigned to work together on this legislation during the 108th session of Congress, their collaboration led to the bill’s enactment.

Chairman Sensenbrenner, known for his staunch conservatism and tough stance on crime, contrasted with Congressman Delahunt’s background as a former prosecutor and his reputation for building bridges across party lines.

Despite their disparities, they shared a commitment to incremental progress and the belief in the necessity of the Innocence Protection Act.

The Act aimed to expand post-conviction DNA testing for individuals facing the death penalty, acknowledging the flaws in the justice system highlighted by cases of wrongful convictions.

Sensenbrenner’s concerns about the potential for wrongful executions intersected with Delahunt’s firsthand knowledge of the system’s shortcomings, driven by the exoneration of innocent individuals through DNA evidence.

The presence of Kirk Bloodsworth, the first death row inmate exonerated by post-conviction DNA evidence, and Debbie Smith, a sexual assault survivor whose case was solved with DNA evidence, underscored the urgency of the legislation.

With time running out in Congress, Sensenbrenner and Delahunt mobilized their deal-making skills to change the legislative process.

Sensenbrenner’s persistence and strategic maneuvering in the House, coupled with outside advocacy efforts, including personal testimonies from individuals affected by DNA evidence, propelled the bill forward.

Leveraging his influence, Sensenbrenner linked the passage of other Senate bills to the Innocence Protection Act, at the end securing its enactment. The successful bipartisan initiative exemplified the potential for collaboration across party lines to address systemic issues in the criminal justice system.

It underscored the importance of both inside and outside strategies in achieving meaningful legislative reform, driven by the determination of bipartisan leaders to overcome obstacles and deliver results.
