Human Trafficking Bill Proposed by Attorney General Passes Unanimously

House Bill 494, a significant rewrite of Idaho’s Human Trafficking laws, achieved unanimous approval in the Idaho Senate, marking a crucial step forward in the state’s efforts to combat this heinous crime.

The bill, which had previously passed the Idaho House without opposition, garnered widespread support from legislators and stakeholders alike.

Attorney General Raúl Labrador emphasized the importance of addressing human trafficking, describing it as a scourge that inflicts profound harm on victims and stains communities.

Labrador highlighted the collaborative efforts between his office and the legislature, which culminated in the unanimous passage of House Bill 494.

He expressed gratitude for the legislature’s support in implementing key recommendations outlined in his office’s report on human trafficking.

House Bill 494 aims to enhance Idaho’s legal framework for combating human trafficking by incorporating essential changes identified by the Attorney General’s Criminal Division.

These changes provide law enforcement with critical tools to investigate and prosecute both labor trafficking and sex trafficking cases effectively.

Notably, the revisions prioritize the needs of victims by shifting the focus from “prostitution” to “commercial sexual activity” and introducing an affirmative defense for individuals coerced into engaging in such activities due to human trafficking.

The bill establishes more explicit and more robust statutes for addressing human trafficking, empowering law enforcement agencies to take decisive action against perpetrators.

It also allocates state-level resources dedicated to combating human trafficking, underscoring Idaho’s commitment to eradicating this form of modern-day slavery.

One significant provision of House Bill 494 authorizes prosecutors to pursue forfeiture proceedings against convicted traffickers, ensuring that they are deprived of any financial gains obtained through their criminal activities.

This measure aims to disrupt the economic incentives driving human trafficking and further deter individuals from engaging in such illicit practices.
