Jamie Foxx is currently facing charges of sexual assault and battery, as detailed in a lawsuit filed on Monday with the New York State Supreme Court. The alleged incident took place in 2015 at Catch NYC, a popular New York City restaurant, according to information outlined in the complaint obtained by CNN. CNN has reached out to representatives for Foxx and the plaintiff’s attorney for comments.
The plaintiff, identified as Jane Doe, asserts in the lawsuit that Foxx “intentionally and without consent used force to offensively touch Plaintiff’s person,” specifically by groping her breasts and genitals. The complaint further suggests that Foxx appeared to be “intoxicated” during the incident. Consequently, the woman claims to have suffered and continues to endure “physical and emotional injuries, anxiety, distress, embarrassment, and economic harm” and is seeking an unspecified amount in damages.
Additionally, the plaintiff is pursuing legal action against the restaurant’s parent company, Catch Hospitality Group, and various associated business entities as defendants. The basis for this includes allegations of negligent hiring, training, and supervision. A representative for the company was not immediately available for comment.
The lawsuit is filed under New York’s Adult Survivors Act, which became effective in late November 2022. This law empowers adult survivors of sexual abuse to sue their abusers in New York, even if the statute of limitations on their claims had previously expired. Notably, the law provides a one-year window for adult survivors of sexual assault to file lawsuits against their perpetrators and is scheduled to expire on Friday.
