From April 2024, New Legislation Grants NRW Enhanced Authority to Modify Felling Licenses in Wales

This week, Natural Resources Wales (NRW) unveiled a significant update to forestry regulations in Wales, enhancing its authority under the Forestry Act to oversee tree-felling operations more effectively.

These amendments empower NRW to modify, suspend, or revoke fishing licenses, providing more excellent protection for wildlife and the environment.

Effective April 1, 2024, the revised Forestry Act equips NRW with expanded powers to impose conditions on fishing licenses. This legislation addresses previous gaps that left critical sites and species vulnerable during forestry activities.

Under the previous Forestry Act of 1967, there were no provisions for incorporating conditions into licenses to safeguard sensitive environmental aspects, potentially leading to environmental harm or breaches of conservation regulations.

Before these enhancements, NRW lacked the authority to intervene in licensed activities, even if unforeseen issues arose, such as the emergence of forestry diseases impacting species selection for replanting.

With the updated legislation, NRW can alter, pause, or cancel licenses when necessary, ensuring compliance with environmental regulations and addressing legal discrepancies.

The newly issued guidance clarifies the conditions imposed on felling licenses and offers applicants transparent information on how these conditions will be enforced. This proactive approach aims to streamline licensing while enhancing environmental protection measures across Wales’ forestry sector.
