Duane Davis, a former gang leader, has filed a motion in the Nevada District Court to dismiss charges against him in the 1996 murder of rapper Tupac Shakur. His attorney, Carl Arnold, argues that the 27-year delay in prosecution constitutes a violation of Davis’ constitutional rights.

Arnold claims this delay has caused irreversible prejudice to his client and undermines the integrity of the justice system. The motion also highlights a lack of corroborating evidence and alleges that authorities failed to honor immunity agreements previously granted to Davis by federal and local officials.

The Clark County District Attorney’s Office has yet to respond to the filing, though District Attorney Steve Wolfson has previously stated that the evidence against Davis is strong. The case largely hinges on Davis’ own accounts, including a 2019 memoir in which he detailed his involvement in the events surrounding Shakur’s death.

Davis, originally from Compton, California, was arrested in September 2023 near Las Vegas. He has pleaded not guilty to first-degree murder charges and has sought release from custody since his arrest.

Davis is accused of orchestrating and facilitating the drive-by shooting that killed Shakur and injured music mogul Marion “Suge” Knight after a brawl at a Las Vegas casino involving Davis’ nephew, Orlando “Baby Lane” Anderson, and Shakur.

Authorities have described the incident as stemming from a rivalry between East Coast Bloods and West Coast Crips gang sects vying for dominance in the gangsta rap genre. Davis has denied firing any shots and claimed to have handed the weapon to Anderson, who has also denied involvement and was killed in an unrelated shooting in 1998.

The motion filed by Davis’ attorney points out the absence of key physical evidence in the case. Police have not recovered the weapon or the vehicle used in the shooting. Additionally, all other individuals present in the car with Davis at the time of the incident are deceased. Despite this, Davis’ own admissions in interviews and his memoir have become central to the prosecution’s case, though his lawyer questions the credibility and admissibility of these statements.

Tupac Shakur, a prominent figure in rap music, was 25 years old when he succumbed to injuries a week after the shooting. Suge Knight survived the attack and is now serving a prison sentence unrelated to the case. The prolonged delay in prosecuting Davis, combined with the lack of physical evidence and unresolved questions about immunity agreements, adds complexity to a case that has remained a subject of intense public and legal scrutiny for nearly three decades.
